1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these terms.
2) The Service
Derrix turns nostalgia into a beautifully organized digital archive. Capture meaningful items with a photo and add a heartfelt note. Derrix helps craft vintage-style commemorative cards and organizes memories by date for easy reflection and sharing as digital keepsakes.
3) Accounts and Security
- You may need an account (name/username/email). You agree to provide accurate information and keep it updated.
- You are responsible for safeguarding your credentials and all activity under your account.
- We may suspend or terminate accounts that violate these terms or to protect the Service, users, or legal compliance.
4) Your Content
- Ownership: you keep ownership of your photos, notes, and other content you submit ("User Content").
- License: you grant Derrix a limited license to host, store, process, and display your User Content solely to provide the Service and deliver features you request.
- Responsibility: you confirm you have the rights to upload and use User Content and that it does not violate laws or others’ rights.
5) Optional Generation Features (Including AI-Assisted Outputs)
Derrix may offer optional features that generate or enhance commemorative cards and written descriptions from your photos and/or text inputs ("Generation Features").
If you choose to use Generation Features, uploads are processed on Derrix Team’s own servers, not shared with any third party, and deleted immediately after processing is complete. We do not perform facial recognition and do not use uploads for training or marketing. Outputs may be inaccurate; review before relying on or sharing.
6) Prohibited Conduct
- Do not use the Service for illegal activities or to violate others’ rights.
- Do not upload content you do not have rights to use.
- Do not attempt to bypass security, scrape, disrupt, or reverse engineer the Service except where allowed by law.
- Do not use the Service to harass, threaten, or harm others.
7) Third-Party Services
The Service may rely on third-party services (for example, hosting or crash reporting). Third-party services are not controlled by Derrix and may be subject to their own terms.
8) Fees and Purchases
Unless explicitly stated in the Service, the Service is provided without charge. If we introduce paid features, we will present applicable terms before you purchase.
9) Intellectual Property
The Service and its underlying software and design are owned by Derrix or its licensors and are protected by intellectual property laws.
10) Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee the Service will be uninterrupted, error-free, or secure.
11) Limitation of Liability
To the maximum extent permitted by law, Derrix will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill arising from or related to the Service.
To the maximum extent permitted by law, Derrix’s total liability will not exceed the amount you paid to Derrix for the Service in the 12 months before the event giving rise to the claim (or USD $100 if you paid nothing), whichever is greater, unless applicable law requires otherwise.
12) Indemnification
You agree to defend, indemnify, and hold harmless Derrix from claims and expenses arising from your User Content, your use of the Service, or your violation of these terms.
13) Governing Law; Dispute Resolution; Binding Arbitration
These terms are governed by the laws of Derrix’s principal place of business (excluding conflict of law principles) unless applicable law requires otherwise.
Before initiating arbitration, you agree to contact us and attempt to resolve disputes informally.
If a dispute cannot be resolved informally, you and Derrix agree to resolve it through final and binding arbitration, except where prohibited by applicable law. Each party waives the right to a trial by judge or jury to the maximum extent permitted by law.
14) Changes
We may update these terms from time to time and will update the effective date above. Continued use after changes take effect constitutes acceptance to the extent permitted by law.
